Terms of Service

1. Acceptance of Terms

By accessing this website, calling, texting, or requesting mobile locksmith services from Kodiak Locksmith (operated by Rocket Jump LLC), you ("Customer", "you") expressly agree to be bound by these Terms of Service ("Terms"). PLEASE NOTE: Section 14 of these Terms contains a binding individual arbitration clause, a jury trial waiver, and a class action waiver that affect your legal rights. If you do not agree to all of these Terms, do not use our website or services.

2. Scope of Services

Kodiak Locksmith provides on-site mobile locksmith services across Los Angeles County, which may include:

• Residential, commercial, and automotive lockout assistance
• Lock rekeying, lock change, and hardware installation
• Car key replacement, duplication, and key fob programming
• Broken key extraction and ignition cylinder servicing

Services may be performed by licensed employees or independent mobile locksmith subcontractors. We reserve the absolute right to decline or stop any service at any time if a technician determines that conditions are unsafe, unlawful, or beyond the scope of mobile field equipment.

3. Service Area & Arrival Estimates

All arrival or completion times quoted over the phone, via text message, or on our website are good-faith estimates only and are not guaranteed. Actual arrival times depend on Los Angeles traffic, weather, distance, and active emergency call volume. Kodiak Locksmith shall not be liable for any delays, missed appointments, or consequential losses resulting from arrival or completion timing.

4. Estimates, Pricing & Payment Terms

Any price range or quote provided over the phone or via SMS is a preliminary estimate based solely on the description you provide. Because lock mechanisms, door alignment, security shielding, and vehicle electronics vary widely, the final price is determined on-site by the technician after physical inspection before work begins.

• Payment Due Upon Completion: Full payment is due immediately upon completion of the service via cash, approved credit/debit card, or approved digital payment.
• Final Acceptance Upon Testing: By paying for the service or taking possession of the serviced property/vehicle/keys on-site, you acknowledge that you have inspected and tested the work and confirmed that it was completed to your satisfaction.
• No Unlawful Chargebacks: All payments for completed and authorized services are final and non-refundable. You agree not to initiate credit/debit card chargebacks to avoid payment for authorized services rendered. In the event of an unwarranted chargeback or non-payment, you agree to reimburse Kodiak Locksmith for all collection costs, administrative fees, and reasonable legal expenses.

5. Customer Representations, Proof of Ownership & Indemnification

In accordance with California law (including Cal. Bus. & Prof. Code § 6980.55), you represent and warrant under penalty of law that you are the lawful owner, tenant, or authorized agent with full legal authority to access, unlock, rekey, or modify the vehicle, residence, or commercial property for which service is requested.

• You agree to provide valid government-issued photo identification and proof of ownership, residency, or authority upon request.
• Indemnification: You agree to fully indemnify, defend, and hold harmless Kodiak Locksmith, Rocket Jump LLC, its owners, and technicians from and against any and all claims, liabilities, damages, fines, and legal fees arising out of (a) any misrepresentation of your authority or ownership, (b) any dispute between you and a landlord, co-owner, HOA, tenant, or third party, or (c) your breach of these Terms.

6. Assumption of Risk & Release of Damage Claims

You understand and acknowledge that locksmith operations - including non-destructive picking, bypassing, drilling of high-security or malfunctioning locks, broken key extraction, automotive door decoding, and electronic immobilizer programming - involve inherent mechanical and electronic risks, especially on worn, rusted, aftermarket, weathered, or previously damaged locks, doors, and vehicles.

• Lockout & Drilling Release: When a lock cannot be picked due to its security design, internal failure, or wear, destructive entry (such as drilling or forcing the cylinder) may be necessary. You expressly assume all risk and release Kodiak Locksmith and its technicians from any liability for cosmetic, mechanical, or structural marks, scratches, weatherstripping wear, paint scuffs, door/frame alignment issues, or lock destruction required to gain entry or complete the requested work.
• Vehicle Electronics & Immobilizers: Connecting diagnostic or key-programming equipment to a vehicle's OBD port or immobilizer system carries inherent risks with aging vehicle batteries, aftermarket alarms, or pre-existing ECU/BCM electrical faults. We are not responsible for pre-existing electrical, battery, starter, or computer module failures in your vehicle.
• Not an Insurer / No Security Guarantee: Kodiak Locksmith is a locksmith service provider, not an insurance company or security guarantor. No lock, key, or hardware is pick-proof, drill-proof, or crime-proof. We make no representation or guarantee that any work or hardware will prevent burglary, theft, unauthorized entry, or personal/property harm.

7. Hardware Disclaimer ("AS-IS") & 90-Day Limited Workmanship Warranty

WE DO NOT MANUFACTURE LOCKS, KEYS, KEY FOBS, TRANSPONDERS, OR SECURITY HARDWARE.

• Hardware Provided "AS-IS": All physical locks, cylinders, keys, remotes, key fobs, batteries, and electronic components (whether supplied by us or provided by you) are furnished "AS IS" and "WITH ALL FAULTS." Kodiak Locksmith does not warrant the manufacturing quality, longevity, or defect-free operation of any physical part or electronic component. Any manufacturer defect is subject solely to whatever warranty, if any, is provided directly by the third-party manufacturer.
• Customer-Supplied Hardware: If you supply your own lock, smart lock, key blank, or key fob for us to install, cut, or program, we assume zero responsibility or liability for the compatibility, functionality, missing parts, or failure of that item, and labor fees remain payable in full regardless of whether customer-supplied hardware functions properly.
• 90-Day Limited Workmanship Warranty (Labor Only) & Exclusions: We provide a limited 90-day workmanship warranty from the service date covering only the direct labor performed by our technician. Our sole obligation under this workmanship warranty, if we determine in our sole discretion that a labor error occurred, is to re-perform the labor adjustment. This workmanship warranty does not cover: (a) any physical hardware, lock, key, or electronic part failure or replacement cost, (b) key fob battery depletion or loss of programming caused by vehicle battery disconnection/drain or ECU faults, (c) doors that sag, shift, or warp due to weather, building settlement, or worn hinges, (d) normal wear and tear, misuse, key bending/breaking, vandalism, or forced entry, or (e) any lock, key, or ignition touched, adjusted, or worked on by you or any third party after our technician leaves.
• DISCLAIMER OF IMPLIED WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KODIAK LOCKSMITH AND ROCKET JUMP LLC EXPRESSLY DISCLAIM ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Maximum Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA AND FEDERAL LAW:

• NO CONSEQUENTIAL DAMAGES: IN NO EVENT SHALL KODIAK LOCKSMITH, ROCKET JUMP LLC, ITS OWNERS, MEMBERS, EMPLOYEES, OR SUBCONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION PROPERTY LOSS, BURGLARY, THEFT, TOWING EXPENSES, DEALERSHIP CHARGES, RENTAL CAR OR HOTEL COSTS, LOST PROFITS, OR LOST WAGES), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• STRICT LIABILITY CAP: OUR TOTAL MAXIMUM AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS, DAMAGES, OR LOSSES ARISING OUT OF OR RELATING TO OUR WEBSITE OR SERVICES (WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE) SHALL BE STRICTLY LIMITED TO THE ACTUAL LABOR FEE PAID BY YOU TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS LESS.

9. Cancellation & Dispatch Policy

You may cancel a service request without charge only if you notify us before a mobile technician has been dispatched to your location. If you cancel after a technician has been dispatched or has arrived on-site, or if you are unreachable upon the technician's arrival, we reserve the right to charge a reasonable dispatch and travel fee. Once on-site work has begun, fees for labor performed are non-refundable.

10. Privacy & Call Recording Consent

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By calling or texting us, you expressly consent to the monitoring and recording of telephone calls and text messages for quality assurance, dispatch verification, and dispute resolution in compliance with California law.

11. SMS/Text Message Communications

By initiating a text message to our phone number or providing your mobile number when requesting service, you expressly consent to receive transactional and customer-care SMS/MMS messages from Kodiak Locksmith regarding your request:

• Purpose: Dispatch updates, technician ETA notifications, quote responses, photo assessments of locks/keys, and service receipts.
• Message Frequency: Varies by interaction (typically 1 to 5 messages per service request).
• Rates: Standard message and data rates from your wireless carrier may apply.
• Opt-Out & Help: Reply STOP at any time to opt out of future messages. Reply HELP for assistance, or contact us at (213) 246-8380 or [email protected].
• No Third-Party Sharing: Consent to receive text messages is not a condition of purchase. Your mobile number is never sold or shared with third parties for marketing purposes. See our Privacy Policy - SMS/Text Messaging Policy for full details.

12. Compliance with Laws

We operate in compliance with applicable California locksmith regulations (California BSIS License #8465).

13. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including traffic accidents, road closures, severe weather, power or telecommunications outages, supply chain shortages, or government actions.

14. Dispute Resolution, Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR CLASS ACTION.

• Mandatory 60-Day Informal Resolution: Before initiating any arbitration or small claims action, you agree to first send a detailed written notice of your concern ("Notice of Dispute") by email to [email protected] including your name, phone number, service date, service address, and the specific relief requested, and allow us sixty (60) days to resolve the matter informally.
• Binding Individual Arbitration: If a dispute is not resolved within 60 days, any controversy, claim, or dispute arising out of or relating to these Terms, our website (including any privacy, CIPA, wiretapping, or TCPA claims), or our locksmith services shall be resolved exclusively through final and binding individual arbitration in Los Angeles County, California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring an eligible individual claim in Los Angeles County Small Claims Court.
• WAIVER OF JURY TRIAL & CLASS ACTION WAIVER: YOU AND KODIAK LOCKSMITH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. BOTH PARTIES EXPRESSLY WAIVE ANY RIGHT TO A TRIAL BY JURY.
• One-Year Limitation Period: Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of our website or services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. Governing Law, Severability & Modifications

These Terms are governed by the laws of the State of California without regard to conflict-of-law principles. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. We reserve the right to update these Terms at any time upon posting to this page.
